Résumé

This dissertation explores the material conditions of Moroccan agricultural workers under seasonal contracts managed by the Office des Migrations Internationales (OMI) -a French administration dedicated to international migration. The methodology is based on semi-directed interviews, archival work and participant observation within the “Collectif de défense des travailleurs agricoles saisonniers” - an organization that defends the rights of seasonal agricultural workers. The main question the thesis attempts to answer is the following: to what extent does the seasonality of the job and the stay of the OMI foreign manpower, as it combines statutory precarity and mobility control, warrant the subjection of this manpower and strictly separate the space and time of production and reproduction of its workforce? The condition of the OMI workers consists of three main axis: -1) the seasonal migratory system, more precisely understood in its socio-historical dimension (colonial origin, evolutions of the migratory utilitarianism in agriculture); -2) mobilizations against the OMI status and the regulatory adjustments developed by the State in order to control/bridle the right of agricultural migrant workers to move to other sectors of activity; -3) the health of seasonal foreign workers, which is nevertheless constructed among three factors : it is rendered invisible, externalized, and in terms of resistance. This thesis conducts a reflection on controlled migration and its limits. It shows to what extent the intensive agriculture of the South of France is dependent of the humanpower, and that the limitation of the right to stay to a temporary work contract tends to rend their employees' rights ineffective. It also highlights that this condition of inferiorized worker may be marginally contested by seasonal workers during selective and contingent collective actions. The thesis also analyses health as the product of struggle of power in which what is at stake is the separation between the production and the reproduction of the migratory workforce. Therefore this dissertation aims at contributing to the reflection on migratory phenomena by attempting to go beyond the « legal/illegal » dichotomy and by privileging the theme of “control”. It brings new elements to the analysis in foregrounding the articulation between the “fait colonial” and post-colonial migrations and informs immigration struggles that heretofore had not been studied. Finally it regenerates the analyzes on occupational health by displacing the focus to the health of the worker as such.
Cette recherche porte sur la condition des ouvriers agricoles marocains sous contrat saisonnier de l'Office des Migrations Internationales. La méthodologie retenue croise entretiens semi-directifs, travail d'archive et observation participante au sein du Collectif de défense des travailleurs agricoles saisonniers. La thèse est traversée par une question centrale : en quoi la saisonnalité de l'emploi et du séjour de la main-d'œuvre étrangère OMI, parce qu'elle allie précarité statutaire et contrôle de sa mobilité, garantit sa sujétion et sépare strictement les espaces-temps de la production et de la reproduction de sa force de travail ? La condition ouvrière OMI est appréhendée à travers trois axes principaux : le système migratoire saisonnier, saisi notamment dans sa dimension sociohistorique (origine coloniale et évolutions de l'utilitarisme migratoire en agriculture) ; les mobilisations contre le statut et les aménagements règlementaires mis en place par l'État pour brider le droit de fuite des travailleurs migrants ; la santé des saisonniers étrangers, qui se construit « malgré tout » entre invisibilisation, externalisation et résistances. Cette thèse constitue en fait une réflexion sur les migrations contrôlées et les limites de ce contrôle. Elle montre en quoi l'agriculture intensive du Sud de la France est dépendante d'une main-d'œuvre, dont la limitation du droit au séjour à un contrat de travail temporaire garantit tendanciellement l'ineffectivité de ses droits. Elle souligne également que cette condition de salariés infériorisés est susceptible d'être marginalement contestée par les saisonniers lors d'actions collectives ponctuelles et contingentes. Elle appréhende enfin la santé comme le produit d'un rapport de forces dont l'enjeu est la séparation de la production et de la reproduction de la force de travail migrante. Cette recherche vise donc à enrichir la réflexion sur les phénomènes migratoires en cherchant à dépasser le binôme « légalité/illégalité » et en privilégiant notamment la thématique du contrôle. Elle apporte des éléments nouveaux pour analyser l'articulation entre le fait colonial et les migrations postcoloniales et documente des luttes de l'immigration jusqu'alors non étudiées. Elle régénère enfin les analyses sur la santé au travail en déplaçant le regard vers la santé du travailleur.
