Résumé

According to a prevailing view, the law of international criminal jurisdictions constitutes a branch of public international law. However, despite a strong institutional anchoring to public international law, this area of law, which is referred to as international criminal law for the purposes of this study, seems to go beyond the framework of public international law. Unprecedented solutions are being developed by international criminal courts to deal with situations referred to them. The international criminal judge plays a key role in this mechanism of overcoming public international law. The emergence of mass terrorism coupled with the trivialization of internal armed conflicts undermines the international humanitarian law that has so far linked international criminal law to public international law. International humanitarian law is no longer a valid channel for linking international criminal law to public international law. This distance allows international criminal law to assert its autonomy. Important structural differences affect international criminal law and public international law and it is no longer possible to ignore the resulting material differentiation. The impossibility of linking the normative set of international criminal law to public international law implies its empowerment. Indeed, international criminal law has specific characteristics of its own. Contrary to what might be imagined, international criminal law has its source on a relatively small scale; the one of the individual. Equally surprisingly, international criminal law draws its force from the model and State structures. Detached from the inadequate model of international public law, international criminal law is now consolidated autonomously around the notion of individualism, with reference to the internal model. Beyond the consolidation of an international criminal law, we are actually witnessing the emergence of a unified or global criminal law.
Selon une opinion dominante, le droit des juridictions pénales internationales constitue une branche du droit international public. Pourtant, malgré un ancrage institutionnel fort au droit international public, ce droit, que l'on qualifie de droit pénal international pour les besoins de cette étude, semble dépasser le cadre du droit international public. Des solutions inédites sont en effet élaborées par les juridictions pénales internationales pour faire face aux situations qui leur sont déférées. Le juge pénal international joue un rôle primordial dans ce mécanisme de dépassement du droit international public. L'émergence d'un terrorisme de masse couplée à la banalisation des conflits armés internes fragilise le droit international humanitaire qui effectuait jusqu'à présent le lien entre droit pénal international et droit international public. Le droit international humanitaire ne constitue donc plus un canal valable permettant de rattacher le droit pénal international au droit international public. Cette prise de distance permet au droit pénal international d'affirmer son autonomie. Des différences structurelles importantes affectent le droit pénal international et le droit international public et il n'est plus possible d'ignorer la différenciation matérielle qui en résulte. L’impossibilité de rattacher l’ensemble normatif que constitue le droit pénal international au droit international public pousse à admettre son autonomisation. Le droit pénal international possède en effet des marques de spécificité propres. Contrairement à ce que l’on pourrait imaginer, le droit pénal international trouve sa source à une échelle relativement infime ; celle de l’individu. De manière tout aussi surprenante, le droit pénal international puise sa force dans la mise en avant du modèle et des structures étatiques. Détaché du modèle inadapté que constituait pour lui le droit international public, le droit pénal international se consolide à présent en toute autonomie autour de la notion d'individualisme et ce, en référence au modèle interne. Au-delà de la consolidation d’un droit pénal international, nous assistons en réalité à l’apparition d’un droit pénal unifié ou encore mondial.
