Analyse critique de la protection juridique des investissements étrangers, un régime déséquilibré au détriment de l'État

Abstract : The legal regime for the protection of foreign investment in its current form is the result of many historical, legal, and economic developments. Currently, the cornerstone of this regime is the treaty-based, investor-state dispute settlement (ISDS) mechanism, a judicial device allowing foreign investors to bring claims before an ad hoc arbitral tribunal over the alleged breach of a treatment obligation by a host State, covered by a treaty signed between the latter and the investor's home State.This study explores the influence that this legal regime and its dispute resolution mechanism have on the State, on its interactions with foreign investors, as well as on the exercise of its sovereign regulatory and policy-making powers. It examines the internal and external factors that shape this influence on the State, stemming from historical geopolitical confrontations, economic effects of globalization, jurisprudential developments, and systemic dysfunctions affecting the arbitration mechanism.
