Le consentement et responsabilité médicale

Résumé

According to Ana Marques « the true consent is the guarantee of the participation to the creation of a social cohesion. » The right relies on the Ethic, agrees with the Ethic and comes in various forms in a conditional way. This resarch aims at showing the evolutions relating to the doctor-patient relationship, viewing the consent, a concept that makes the link in this remarkable symposium. The jurist can therefore see the construction as he reads the texts and the jurisprudence. The importance of the consent takes part in the transformation of the doctor’s social position, within the social space and the doctor-patient-state relationship. From a remakable symposium emerges a new triptych. What is at stake here is that the collective and individual visions of the consent are built as opposites. Indeed, the health democracy is a rhetoric : we cannot talk about it but under concrete devices. Despite the confrontation between fundamental rights and security (especially health security), there are two opposite movements. Referring to the patient, taken in his individuality, his fundamental rights prevail but confronted to the community, this latter prevails. How can the dispute around the question of the patient's consent find a balance between these two sides ? The legislator ventures to intervene in a scientific field which is fallible because uncertain. Between what is implicit, explicit, assumed, asserted, possible or not, it is not easy to legislate and compensate a prejudice endured by a patient, user of the health system. This is where the relations between the administration, the doctors and the experts play a part via some tools : recommendations are diverted by the administration on power struggles, transforming what is legitimate for everyone. How do the legislator and the judge arbitrate and carry out an arbitrage operation in this purpose ? At the end, can the patient negociate the decisions concerning his health ? Is he in a position of compromise and mutual action ? Or does he manage to force his will in other spheres than as regards the end of life ? Isn’t the thread in the evolution of the principle of consent the respect of the dignity of a human being, the information of the consequences of the medical procedure ?
Pour Ana Marques, « Le consentement réel est le gage de la participation à la construction du lien social ». Le droit s’appuie sur la morale, s’accorde sur cette morale et se décline de façon conditionnelle. Cette recherche vise à présenter les évolutions relatives à la relation médecin/malade au prisme du consentement, concept qui vient faire la médiation au sein de ce colloque singulier. Le juriste peut ainsi observer la construction au fur et à mesure des textes et de la jurisprudence. La valorisation de la place du consentement participe à la transformation de la position sociale du médecin, au sein de l’espace social, et des relations entre patients/médecins/Etat. D’un colloque singulier, on assiste à un nouveau triptyque. Tout l’enjeu de la vision collective et individuelle du consentement du patient est qu’elles sont conçues comme des opposés. En effet, la démocratie sanitaire est une rhétorique : on ne peut en parler que sous la forme de dispositifs concrets. Malgré la confrontation entre droits fondamentaux et sécurité (sanitaire notamment), il y a deux mouvements contraires. Lorsqu’il est question du patient, pris dans son individualité, ses droits fondamentaux priment, mais lorsqu’il est confronté à la collectivité, c’est cette dernière qui prévaut. Comment les contentieux autour de la question du consentement du patient trouvent un équilibre entre ces deux versants ? Le législateur se risque à intervenir dans un domaine scientifique, faillible car aléatoire. Entre ce qui est implicite, explicite, supposé, affirmé, possible ou non, il n’est pas simple de légiférer et d’indemniser un préjudice subi par un patient, usager du système de santé. C’est alors qu’interviennent les liens entre l’administration, les médecins et les experts, via des outils : des recommandations qui sont détournées par l’administration sur des jeux de pouvoirs, transformant ce qui est légitime pour chacun. Comment le législateur et le juge arbitrent-ils et exercent-ils un arbitrage à cette attention ? Au final, le patient négocie-t-il les décisions qui concernent sa santé ? Se place-t-il dans une position de compromis et d’action réciproque ? Ou parvient-il à imposer ses volontés dans d’autres domaines qu’en matière de fin de vie ? Le fil conducteur à l’évolution du principe du consentement n’est-il pas le respect de la dignité de la personne humaine, de l’information aux conséquences de l’acte médical ?
